TMS Luxury Da Nang Hotel repeatedly violates construction regulations

The Ngu Hanh Son District People’s Committee (PC) in Da Nang recently instructed relevant local agencies, in a prompt fashion, to inspect and deal with the TMS Luxury Da Nang Hotel project for its repeated violations of the construction order regulations.

Located at land lot No A3, Vo Nguyen Giap Street, My An Ward, the project consists of 25 storeys and 2 basement levels.

The Da Nang-based MS Hotel Da Nang JSC, a member of the TMS Group, is the project’s investor, whilst the city-headquartered Hong Tri Viet Construction JSC is the contractor.

In August 2017, the municipal Department of Construction twice imposed a total fine of 14 million VND on the investor and contractor of the project for the unlicensed discharge of wastewater into the city’s drainage system.

On 11 June 2018, the Ngu Hanh Son District PC also imposed 40 million VND in fines on the project’s investor, the MS Hotel Da Nang JSC, for having implemented unlicenced construction items at this project.

Accordingly, regardless of the already-approved designs, the company has intentionally carried out the implementation of some unlicenced facilities, including the illegal building of an additional wastewater treatment room in the basement No B2 and a total of 10 additional rooms from the 14th to 23rd storeys, and an expansion of a swimming pool.

In a response to these violations, the district authorities immediately asked the investor to temporarily suspend the construction work, and urged relevant municipal agencies to adjust the construction permit previously granted to the project.

Still worse, since mid-July, during the construction work, many materials such as iron rods and wooden poles have fell from heights onto a restaurant located adjacent to the project site. The restaurant’s owners, therefore, have expressed their deep safety concern for their staff and customers.

According to the My An Ward PC, the project has been found repeatedly violating the labour safety regulations and this has posed a danger to people and other construction works nearby.
