Da Nang issues warnings against illegally converting agricultural into residential land

According to the in-force Vietnamese law, individuals or households that are not directly engaged in agricultural production are not allowed to receive a transfer or donation of paddy land use rights.However, Hoa Vang District has, over recent days, seen some suspects involved in the illegal transfer of agricultural land use rights that goes against the regulations.

Many fraudsters called on urban dwellers to buy large agricultural land plots in Hoa Vang District at cheap prices.

On social networking sites, there is a lot of information about selling "attractive" agricultural land such as “1ha of agricultural land in front of the road to the Cu De River in Hoa Bac commune”; “2,000m2 of farming land on the bank of Cu De River offered at only VND1.5 billion”.

Still worse, there are even highly-inviting advertisements for the illegal sale of forest and agricultural land that have not yet been granted any land use right certificate, such as “600,000m2 of forest land in Ba Na Hills priced at VND60,000 /m2” and “Only with VND600 million, you obtain the use right over 4,385m2 of land ideal for beautiful gardens”/

It can be seen that agricultural, forest land and riverside land are much “hunted” for trades mainly concentrate in mountainous communes such as Hoa Bac, Hoa Ninh, Hoa Lien, Hoa Son, Hoa Phu and Hoa Phong, all belonging to Hoa Vang District.

The branch of the Da Nang Land Registration Office in Hoa Vang District does not handle procedures for the change of use purpose for pure agricultural land because the land use plan in Hoa Vang District by 2030  has yet to be approved by the competent authority.

Not handling procedures for transferring agricultural into residential land

According to the municipal Department of Natural Resources and Environment, recently, on social networking sites, a number of individual accounts and groups of people have spontaneously posted many advertising articles to support the conversion of agricultural into residential land in a bid to make illegal profit.

This move is an illegal act and destabilizes security situation and social order in rural areas, including Hoa Vang District.

Currently, the authority that is in charge of handling the change of land use purpose in Da Nang does not consider resolving any procedures for changing the land use purpose from purely agricultural into residential land.
