If the developer does not comply with the notice within the time set out for it, the district authorities will enforce the demolition order in accordance with the city’s rules.

In addition, the district authorities will inform people living in the illegally-built apartments about the demolition work, and ask them to strictly abide by the national law on residence.

Some relevant agencies, including the Department of Police, the Power Company, and the Water Supply Company, will join forces with the district authorities to enforce the order to ensure the safety of people before and during the coercion process.

The municipal Department of Foreign Affairs is responsible for sending the demolition notice to diplomatic representative offices and foreign consulate offices in the city in order for them to inform their staff who are staying at this complex.

According to the construction licence granted by the municipal Department of Construction, the Muong Thanh Hotel and Son Tra High-Class Apartment Complex project which is developed by the Dien Bien Construction Company No 1 has 42 storeys and 2 basement levels. The 2nd to 5th storeys in the apartment block are designated for a parking area, a kindergarten, and some public areas.

However, during construction process, the company has not followed the approved designs, and on its own turned each of the four storeys into 26 apartments for sale.

In addition, the apartment block’s 35th storey is designed for a shelter according to the construction licence, but in fact 8 apartments have been built there and they have been put into use.

On the 41st and 42nd storeys, the total permitted area for construction on each storey is only 313m2. However, a total of 26 apartments covering a total area of 4.393m2 have been built and put into use on each storey.
